Board Meeting Minutes
June 24
The regular meeting of the Village of Divernon Board of Trustees was held on Wednesday June 24, 2009 at the Divernon Village Hall. Mayor Wade Carter called the meeting to order at 7:01 pm. After all in attendance recited the Pledge of Allegiance, the Clerk called roll call: Melissa Layton “Here”, Randy Rhodes “Here”, Randy Rieke “Here”, Michelle Bennett “Here”, Joe Bukantos “Here”. Also present Police Chief Eric Kirbach, Superintendent Larry Rhodes and Treasurer Lucille Hundley. Not Present John Caudle.
The minutes for the June 10th meeting were presented. After any corrections or additions were made a motion to approve was made by R. Rhodes. Second by M. Bennett. Motion passed 5-0.
The bills were presented for approval. After additions and corrections were made, motion to approve bills by R. Rhodes. Second by R. Rieke. Motion passed 5-0.
Mayor Carter recognized visitor Rick Morgan regarding notice for a curfew violation. Two tickets were issued to R. Morgan and his daughter. Due to a family emergency his daughter was out after hours. This is the second notice given to the daughter. J. Bukantos suggested dismissing the $50.00 fine and paying the $25.00 fine. Motion to dismiss the $50.00 fine and pay the $25.00 fine by J. Bukantos. Second by M. Layton. Motion passed 5-0.
Tom Masters discussed the sewer charges for filling a pool. The sewer charges were reduced in 2007 and T. Masters feels this should be available each year. The Ordinance reads a onetime courtesy is given per lifetime. T. Master is also questioning the quality of the tap water at this time. Mayor Carter read a letter from the Otter Lake Water Commission that explains the algae bloom that causes the water to have a dirt flavor. Mayor Carter suggested looking further into the Ordinance for sewer rates for filling pools. M. Layton suggested using the bulk water system to fill which does not charge a sewer rate.
James Files discussed a noise violation fine that was received. Chief Kirbach explained the situation to the Board. J. Files stated he had not received a notice prior to the fine being received. J. Bukantos suggested reducing the fine to a warning. Motion to reduce to a warning by M. Bennett. Second by M. Layton. Motion passed 5-0.
Supervisor (L. Rhodes):
Supervisor Rhodes has received a request from the contractor for the Masons Building to waive the fees for the water, sewer and gas tap. L. Rhodes explained the fees and what will be refunded to the Masons. The Board agrees not to waive tap fee.
Supervisor Rhodes presented a letter from Benton and Associates regarding the responsibility of the road at the south of State Street. According to IDOT the road is the responsibility of the Village of Divernon. L. Rhodes turned the matter over to J. Bukantos to contact IDOT.
Police:
Chief Kirbach discussed the hiring of new officers.
Treasurer (L. Hundley):
The monthly Treasurer’s report was presented.
Mayor Carter presented a letter from John Caudle regarding his resignation from the Board. Mayor Carter suggested appointing Tom Burke to fill the position for the remainder of the 2 year term. The Board is in full agreement with the Mayor’s decision.
Mayor Carter presented the contract with Sangamon County Animal Control for approval. Motion to approve the Sangamon County Animal Control Agreement at the cost of $312.91 by R. Rhodes. Second by M. Layton. Motion passed 5-0.
Mayor Carter excused himself from the meeting and Mayor Pro-tem R. Rhodes presided over the remainder of the meeting.
Committee Reports
Public Works, Streets, Alleys, and Utilities (J. Bukantos):
J. Bukantos and R. Rhodes discussed the need for sign project. Monies appropriated for FY 10 may need to be increased to $10,000.00.
Finance ( R. Rieke):
R. Rieke is working on the Appropriation Ordinance for FY 10.
Personnel/Human Resources (R. Rhodes):
Nothing to report.
Health & Safety (M. Bennett):
M. Bennett stated the property at 209 E. Dodd is being maintained by safeguard. This is a service from the loan holder to protect their investment.
M. Bennett stated a letter had been sent to the homeowner on Lincoln street regarding the dumpster and having it removed.
Community Development (M. Layton):
M. Layton questioned if there are flags available to place around the Village Square for the 4th of July. Superintendent Rhodes will have 8 flags purchased to be placed around the square.
M. Layton stated the suggestion was made to have a corner decoration done at 3rd and Brown.
Clerk Oldridge suggested a possible handicap swing to be placed at the Village square.
Building, Grounds and Lights():
R. Rhodes has contacted the Village Attorney regarding the final paperwork needed from the contractor for the new garage.
Old Business
Nothing to report.
New Business
Clerk Oldridge presented 3 liquor and gaming licenses for approval. Motion to approve all 3 licenses by J. Bukantos. Second by R. Rieke. Motion passed 5-0.
Clerk Oldridge presented a building permit from the Corner Bar for a new handicap ramp to be placed. A Variance will be needed on the property prior to approval.
