Board Meeting Minutes
September 22
The regular meeting of the Village of Divernon Board of Trustees was held on Wednesday September 22, 2010, at the Divernon Village Hall. Acting Mayor Randy Rhodes called the meeting to order at 7:13 pm. After all in attendance recited the Pledge of Allegiance, The Clerk called roll call: Acting Mayor Randy Rhodes “Here”, Tom Burke “Here”, Kelly Horn “Here”, Randy Rieke “Here” and Joe Bukantos “Here”. Also present Superintendent Rhodes and Chief Kirbach. Not present Treasurer L. Hundley, Melissa Layton and Dianne Brenning. Arriving late Joe Bukantos.
The minutes for the September 8th regular meeting were presented. After any additions or corrections were made a motion to approve was made by R. Rieke. Second by T. Burke. Motion passed 3-1. K. Horn voting “Present”.
The bills were presented for approval. Motion to approve bills by R. Rieke. Second by T. Burke. Motion passed 4-0.
Supervisor (L. Rhodes):
Supervisor Rhodes stated the Public Works Department has been working on storm tiles and drain basins. They are using a camera to see what repairs are needed in these areas.
The pump station at the truck stop has been undergoing maintenance.
Supervisor Rhodes stated the area of concern in High Acres has been addressed.
Supervisor Rhodes will check with Carter Tree Service regarding the trees at the Village Square that are in need of attention.
Police:
Chief Kirbach stated Officer Bertoni has resigned from the Department.
Chief Kirbach will be placing an ad for part time officers.
Treasurer (L. Hundley):
Nothing to report.
Committee Reports
Public Works, Streets, Alleys, and Utilities (J. Bukantos):
Acting Mayor Rhodes opened the sidewalk bids for 590 feet of sidewalk replacement with ADA requirements in place.
- Neely Construction, $22,442.00
- Cloyd Builders, $13.00 per square foot.
- Bland Builders, 5975.00
- Schmoldt and Daniels, $6560.00
Motion to accept bid from Bland Builders for the amount of $5975.00 by T. Burke. Second by J. Bukantos. Motion passed 4-0.
An ad will be placed for the residential sidewalk replacement program to begin.
Randy Rieke presented information on the past water rates. The water fund at this time is losing money. As a result of past increases from the Otter Lake Water Commission the Village will need to increase its water rates. There will be no increases in the sewer charges. Discussion was held on the need for the increase to make future improvements to the Village. Suggestion was made to increase the
water rates to $13.00 per 2000 gallon usage and $6.55 per each additional 1000 gallons. Bulk rates will also increase to $6.55 per 1000 gallons. Commercial rates will increase to $99.30 per minimum of 20,000 gallons and $6.55 for each additional 1000 gallons. These rates will be effective on the November 5th billing cycle. Motion to increase rates as stated by T. Burke. Second by J. Bukantos. Motion passed 4-0.
J. Bukantos stated there is an area at Kenny and Second Street that needs to be filled due to erosion. This area will be checked to see what can be done to improve the problem.
Acting Mayor Rhodes presented information from the Village Attorney regarding the possibility of using monies from the gas fund towards improvements for the Village. According to the past Ordinance it states the monies can be used toward improvements to the Village.
Finance (R. Rieke):

Personnel/Human Resources (K. Horn):
K. Horn stated the Divernon Safe Routes to School application has been approved by the IDOT. K. Horn will meet with Mike Severs to start the funding application process. The School District was the first in the State of Illinois to receive application approval.
Health & Safety (T. Burke):
T. Burke stated the inspection was completed on the Caughlin property. Sangamon County will be contacting the State’s Attorney’s office for any further matters to be completed. An additional inspection is to be held on 10-1-10.
T. Burke is waiting on information from the Sangamon County Health Department on the property at 333 S. State. Traps have been placed to catch the vermin on the property.
Community Development (M. Layton):
Nothing to report.
Building, Grounds and Lights (D. Brenning):
Nothing to report.
Old Business
Acting Mayor Rhodes discussed the possible drive thru window to be placed at Rick’s Grill. Discussion was held on making the alley one way with no parking sign at the west end and do not enter sign at the east end. Discussion was held on the concerns of safety in the area due to blind spots at the east end of the alley. Issue will be tabled for future discussion.
New Business
Motion to amend the minute’s from 8-25-10 to include Dianne Brenning as present by R. Rieke. Second by K. Horn. Motion passed 4-0.
Motion to go into Executive session to discuss personnel and litigation by K. Horn at 9:21. pm.
